How would you describe your day job to a child?

What do you like most about your job?

Although there are lots of aspects to my job that are routine because of weekly/monthly processes, I also love the challenges that come in so that no two days are exactly the same.

What does a typical day look like for you and what are you currently working on?

In my job, there isn’t really a typical day.  I can be doing anything from streamlining or introducing policies, liaising with candidates and clients, running payroll and resolving any escalated issues.

When was the last time you laughed so hard you cried?

One of my colleagues looks like Chesney from Coronation Street and is really not very happy about it.  This came up on Friday and we were all crying with laughter, well apart from the one who looks like Chesney!  I can’t say anything because due to me being a bit vertically challenged, when I put my glasses on then I look like Edna from The Incredibles!

Name the four people you would most like to be stuck in a lift with?

David Attenborough – he’s a legend!  What an amazing life and it must be fascinating to hear him speak firsthand about the places he’s been and what he’s experienced.

Greg Davies – such a funny man and he would definitely keep us entertained until the lift was working again!

Joe Elliott, Def Leppard – first saw the band back in the mid 80’s and they are still one of my favourites so he can just sing to me.

Kiefer Sutherland – erm, just because….

What is your guilty pleasure?

It’s not really a guilty pleasure because I don’t feel guilty or ashamed about it.  One of my favourite pastimes is music, especially seeing it live.  I am tone deaf and once played the violin badly but put me in front of a live band in a concert hall or a field, give me a pint of cider and I am in my element.

My other guilty please is my black Labrador – Lola.  She’s such a beautiful dog – not that I’m biased!

What is an Umbrella Company?

You may have an upcoming assignment and have been instructed by your agency that you will be getting paid via an Umbrella Company but are unsure exactly what an Umbrella Company is.

New Red Planet, an FCSA accredited payroll provider, will explain what an umbrella company is, how it can benefit you as a contractor, and why you should choose an FCSA Accredited Umbrella for your on-payroll assignments.

In summary, an umbrella company is considered the main alternative to creating your own limited company as a contractor.

The main responsibilities are to supply you with employment status (and related statutory rights) while on assignment and to manage all your tax obligations to HMRC for the work you are doing.

Umbrella companies are becoming more prominent in the contractor marketplace since the changes to IR35 legislation in the Public Sector in 2017 and in the Private Sector in 2021, which saw many contractors moving to on-payroll assignments, the majority of which is via an umbrella company.

How does an umbrella company work?

The Umbrella Process for contractors

An umbrella company is an employer of contractors and freelance professionals who complete numerous assignments at various locations for recruitment agencies and/or end hirers. The umbrella company enters into an employment contract with the worker and a service contract with the agency.

This mechanism gives the worker freedom to undertake a series of temporary assignments via a variety of agencies/hirers whilst having continuity of employment with all statutory rights and benefits.

How Your Pay is Calculated

The umbrella company receives assignment income paid by the agency for the work undertaken.

Like any employer, the umbrella must cover employment costs, including the Employer’s National Insurance, holiday pay, the Apprenticeship Levy, and pension contributions.

These employment costs are deducted from the assignment income. Umbrellas also retain a small margin to cover their costs for the services they provide. This is also deducted from the assignment income and the balance is the workers’ gross pay.

What are the benefits of an umbrella company?

There are a variety of advantages involved when it comes to deciding to operate under an umbrella company. These include:

    • In certain cases, you may also be able to claim for work-related expenses. This means that these would be free of national insurance and tax deductions. *Remember that if this is something that you can do, you will need to make sure that you keep all your receipts, as these will be needed later in order to make a claim to HM Revenue & Customs.
    • You could also be entitled to a company workplace pension scheme.
    • It can be an incredibly convenient way to get paid as a freelancer or contractor compared to setting up a limited company, as the umbrella company sorts out the paperwork on your behalf, making the process easy and far less time-consuming for you, enabling you to get on with the work that you need to.
    • You won’t need to calculate your own tax. This is because the umbrella company deducts all national insurance and tax contributions from your salary prior to you receiving it, meaning that you have one less thing to think about.
    • Umbrella companies can be beneficial to contractors, regardless of their salary rates.
    • They can be used by freelancers and contractors on either long or short-term contracts.
    • Employment rights, including all statutory rights and benefits such as holiday pay, maternity, paternity, sick leave, pension, etc.
    • Employment history and continuity while working on a contingent, multi-location basis (notably to support access to finance, housing/mortgages, etc.).
    • Joined-up pay from fragmented working:
    • Many workers will perform multiple assignments during a week or a month
    • Umbrellas consolidate their worker’s earnings and ensure appropriate taxes are paid
    • Peace of mind that tax is paid appropriately, with no need to submit an annual self-assessment return to HMRC.
    • Employee/HR support in the unlikely event that an individual needs HR advice, such as a grievance case, as their employer the umbrella company will have processes to support them.
    • Ability to claim travel and subsistence expenses subject to status.

      What is an Umbrella Company?

      FCSA is disappointed to see that the government has not included an Employment Bill within the Queen’s speech, which could have delivered greater protection for contingency workers.

      Operating in the absence of sector regulation, FCSA represents over 75 compliant umbrella organisations working in the UK, which in turn support more than 120,000 freelancers.

      Earlier this year, the organisation announced it was in favour of light-touch regulation of the sector, to better uphold and drive forward standards and compliance within the industry. Our CEO, Chris Bryce said:

      “We were anticipating an employment bill to be included within the Queen’s speech, which could have delivered greater regulation and protection for contingent workers. It’s a missed opportunity from the government that they didn’t heed the industry’s call to introduce much-needed regulation for the umbrella sector.

      “We absolutely support the introduction of effective regulation in the professional employment services sector, as we believe it will further strengthen standards in the industry, ensuring businesses comply with the spirit and letter of the law and thus better protect workers.

      “We believe many aspects of employment law need to be urgently addressed – so, despite the disappointing news, it’s a goal we’ll continue to work towards in the absence of wider regulation.”

      FCSA believes an outright ban on the umbrella sector would simply see unscrupulous operators exploit other employment loopholes.

      The Association is in favour of regulation but calls on it to be well-funded and policed, however, our position remains that a misguided, outright ban risks leading to a situation where perfidious operators simply find other routes to capitalise on technicalities and this would leave workers without specific protection.

      FCSA’s purpose is to provide contractors with a choice of trusted, ethical and compliant providers, compliant with both the letter and the spirit of the law.

      Regulation could go a long way in limiting the misconceptions of the umbrella sector; helping to push forward best practices among compliant operators and better protect workers across the UK.

      However, any regulation must be fit for purpose, and it must be properly enforced and policed. It is essential that such an undertaking is adequately resourced, as we know there are significant funds available to those who will try to avoid compliance.

      FCSA are determined to continue to engage with relevant authorities – including BEIS and HMRC – to help shape regulation that will be effective in achieving its intended aims and that will protect the sector as a whole, including contractors and service providers.

      Finance Bill 2021 – What are HMRC’s new powers in the battle against Tax & VAT avoidance?

      HMRC are tightening the laws around the facilitation of TAX & VAT avoidance

      HMRC are tightening the laws around the facilitation of TAX & VAT avoidance through the revised Finance Bill 2021.

      HMRC will be sending out further details with some of them listed below, but it is clear that Government is keen to tackle tax avoidance and so there is no more appropriate time to review and enhance your supply chain due diligence process to ensure it is both secure for your business and your contractors.

      Nobody wants to end up with a hefty tax bill that could include fines on top of it.

      Due diligence may seem a daunting hurdle but it can no longer be left at the bottom of the agenda and now, more than ever, it should be a key topic of discussion and enhancement across all businesses and sectors.

      What Have HMRC said they are looking to do?

      Follower notice and penalties

      • A Follower Notice (FN) is a legal request from HMRC to a taxpayer who has used a tax avoidance scheme to remove the tax advantage they have claimed. FNs can only be used when the scheme has been defeated in another person’s litigation.
      • A consultation opened in December 2020 sought views on how FNs could place a stronger emphasis on any continued appeal being without merit or substance to those who continued their dispute with HMRC following receipt of an FN.
      • The consultation put forward suggestions of a reduction in FN penalties from 50% of the disputed tax to 30% and to introduce a further 20% for those cases in which the tax tribunal concluded the litigation was time-wasting, vexatious or otherwise without merit.
      • Generally, respondents to the consultation expressed their dissatisfaction with the FN regime but all five respondents supported some level of reduction to the FN penalty.
      • In a report published by the House of Lords Economic Affairs Committee, it was recommended that FN penalties should be abolished. Lord Judge commented on that report and stated that it should be left to the courts to decide if litigation was frivolous or time-wasting and whether to penalise litigants in such cases.
      • Despite disagreeing with the report, Government did acknowledge that a better balance should be struck between encouraging taxpayers who have used avoidance schemes that are shown not to work and allowing those who genuinely believe their case is different from a previous case to continue to pursue their dispute.
      • The government intend to reduce the penalty to 30% for those taxpayers who have received an FN with the scope to apply a further penalty of 20% if strict criteria set out in the legislation are met which includes the following;
        • An FN has been issued.
        • Corrective action has not been taken.
        • An FN penalty has been issued under s208 Finance Act 2014 and not withdrawn; and
        • One of the following conditions is met;
          • The tax tribunal or court strikes out a taxpayer’s appeal on the grounds either that it has no reasonable prospect of success or that there is an abuse of process; or
          • The tax tribunal or court makes a statement that the taxpayer has acted unreasonably in bringing or conducting the proceedings.

      Tackling Promoters of Tax Avoidance

      • The government will be legislating in Finance Bill 2021 to strengthen the existing anti-avoidance powers and tighten the rules designed to tackle promoters and enablers of tax avoidance schemes.
      • Some of the proposed changes include;
        • Enabling HMRC to obtain information at a much earlier stage than it can now about tax avoidance schemes that have not been notified under Disclosure of Tax Avoidance Schemes (DOTAS) or Disclosure of Tax Avoidance Schemes for VAT and other Indirect Taxes (DASVOIT).
        • HMRC would be able to issue an initial notice to those that they suspect are promoters providing a thirty-day deadline to provide responses on why the scheme is not notifiable. HMRC will publish guidance on the internal governance processes to ensure that the powers are used appropriately.
        • HMRC will be able to issue “Stop Notices” to promoters of tax avoidance schemes earlier than it can now to prevent a mass rollout of a scheme. We can expect further guidance from HMRC on how they will issue these Stop Notices.
        • Penalties will apply to promoters who fail to adhere to a Stop Notice.
        • HMRC will be able to use its powers under Schedule 36 Finance Act 2008 to check whether a person is or may become, liable to enablers penalties.
